On August 31, the PSCW sent its final proposed rule draft on the siting and operation of wind energy systems to the Wisconsin legislature. See previous entries. Commissioner Lauren Azar sent a separate letter to the legislature criticizing the commission majority for inadequately protecting the health and safety of non-participating residents. She would have required turbine owners to purchase the residence of anyone proving damage to health. The energy committees in both houses of the legislature will consider the rule, and may hold hearings. The rule could be referred back to the PSCW for modifications or the legislature could pass a bill killing the rule. If there is no objection or if the Commission makes requested changes, the rule will be published and go into effect.

Key provisions: Noise: 50dBA daytime, 45dBA nighttime. Setback: 3.1 X turbine height at blade tip.

Standards are advisory for 100+ projects, and mirror the PSCW's most recent large-scale wind development order, Glacier Hills Wind Farm (We Energies), docket 6630-CE-302.
